Reserve a rental

1. Assumption of risk

I understand that kayaking, canoeing, paddleboarding and related water activities involve inherent and significant risks, including but not limited to:

• Drowning
• Capsizing
• Collision with objects or other people, boats
• Changing water and weather conditions
• Equipment malfunction
• Serious bodily injury or death

I knowingly and voluntarily assume all risks, known or unknown, foreseeable or unforeseeable.

2. Release of liability, including negligence

To the fullest extent permitted by law, I hereby release, waive, discharge and covenant not to sue Ace Marine East, LLC, including its owners, members, officers, employees, agents and affiliates ("Released Parties"), from any and all liability, including:

• Personal injury or death
• Property damage or loss
• Equipment failure

This release specifically includes claims arising from the negligence of the Released Parties.

3. Indemnification and hold harmless

I agree to defend, indemnify and hold harmless the Released Parties from any and all claims, damages, losses or expenses (including attorneys' fees) arising from:

• My participation
• My use of equipment
• Any injury or damage caused by me or my party

4. Equipment acceptance and responsibility

I acknowledge that:

• I have inspected all equipment and accept it "as is"
• Equipment is in good working condition
• I am responsible for proper use and care
• I will report defects immediately
• I am financially responsible for damage, loss or theft

5. Safety requirements

I agree that:

• I will wear a U.S. Coast Guard approved PFD at all times
• All participants will comply
• I will operate equipment safely and follow all instructions

6. Return, damage and late fees

I agree to:

• Return all equipment in the same condition (normal wear excepted)
• Pay for any damage, loss or theft
• Pay late fees (charged after a 15 minute grace period)

7. Medical authorization

I certify that I am physically capable of participating.

I authorize Ace Marine East, LLC to obtain emergency medical care if necessary and agree to be responsible for all associated costs.

8. Photo and media release

I grant permission for Ace Marine East, LLC to use photographs or videos for marketing or promotional purposes without compensation.

9. Governing law, venue and jurisdiction

This Agreement is governed by the laws of the State of Connecticut.

Any legal action shall be brought exclusively in Middlesex County, Connecticut, and I consent to that jurisdiction.

10. Severability

If any provision is found unenforceable, all remaining provisions shall remain in full force and effect.

11. Entire agreement

This is the complete and entire agreement and supersedes any prior statements or agreements.

12. Minor participants (if applicable)

I am the parent or legal guardian of the minor(s) listed below and:

• Consent to participation
• Agree to all terms on their behalf
• Release and indemnify the Released Parties from any claims brought by or on behalf of the minor
